Bankruptcy Laws

The Bankruptcy Law provides protection for debtors and enables them to discharge their financial obligations. Bankruptcy law is a legislative procedure through which individuals or other entities that cannot pay off debts can seek relief from some or all of their debts in a bankruptcy court. In many jurisdictions, bankruptcy is legally imposed by a chapter 13 bankruptcy court order, usually initiated by the plaintiff. The process is supervised and advised by special boards called the "Pages," which are appointed by the courts.

There are two broad classifications of bankruptcy, namely liquidation and reorganization. Under liquidation bankruptcy law, the trustee or liquidator of the bankruptcy proceeding liquidates the assets of the debtor to pay off all debts. Under reorganization bankruptcy law, the court appoints an "irsvency administrator" to reorganize the debt structure of the debtor's business. Usually the court delegates this task to an individual under its supervision.

One of the primary purposes of the Bankruptcy Law is to provide a method by which to eliminate unsecured debts through the process of reorganization. The primary objective of Bankruptcy Law is to protect the rights of the creditors to recover the funds they are owed. It also aims at enabling the debtor to pay the debts in a prompt manner. Through this process, the courts avoid the necessity of resorting to "judgment bankruptcy", whereby the creditor's full claim is wiped out by the bankruptcy process. Bankruptcy Law enables a debtor to settle his/her debts in the most convenient manner possible.

The bankruptcy process is both complex and lengthy. Therefore, there are specific laws formulated to deal with each issue. Most jurisdictions use a variant of the Federal Statute of Limitations for filing bankruptcy cases. This Statute of Limitations (FRC) typically runs for one year after the filing of the bankruptcy case. A bankruptcy case can only be filed within the applicable period of time or it will be deemed to have expired.

The Bankruptcy Law is based on the "follow the money" principle. This principle dictates that people who have huge unsecured debts and are unable to pay them off should apply for bankruptcy and request for its protection. Under the supervision of the courts, the individual must undergo counseling as well as various workouts in order to ensure that he/she will not repeat the same mistakes in the future. There are several other types of bankruptcy such as debt settlement, debt consolidation, and credit counseling. However, these are not included in the legal system of each state. Each bankruptcy case is handled differently by the courts depending on its nature and the gravity of the circumstances. Therefore, it is important that you seek the help of an experienced bankruptcy lawyer to determine which type of bankruptcy laws would be applicable to your case.  You can get more enlightened on this topic by reading here: https://www.encyclopedia.com/history/encyclopedias-almanacs-transcripts-and-maps/bankruptcy-law.
